Can I Get Off the Sex Offender List?

In 2021, California passed Senate Bill 384, marking a significant change in the state’s approach to the sex offender registry. Under previous laws, once an individual’s name was added to the registry, it was a lifelong commitment. However, with the enactment of this law, individuals now find themselves categorized in a tiered system that may allow for removal from the registry, based on the severity of their conviction.

Since this law was passed, many individuals, including some of our clients, have successfully petitioned for removal from the registry. This new system has provided hope and relief for many who were convicted of non-violent and less severe sex-related offenses, who previously found themselves listed alongside those convicted of serious and violent sexual crimes. Now, sex offenders are categorized based on the seriousness of their offenses, ensuring they are monitored appropriately according to the level of threat they may pose.

How Does the Tiered System Work?

The tiered system operates by classifying offenders based on the severity of their original offense. After completing the mandated registration period for their tier, individuals may petition the court for removal from the registry. If successful, they will no longer be required to register as sex offenders or appear on the ‘Megan’s Law’ website.

Here are the key tiers:

  • Tier One: Requires a minimum of 10 years on the registry and applies to lesser offenses such as misdemeanor sexual battery, misdemeanor indecent exposure, inducing sex by fraud, and misdemeanor possession of child pornography, among others.
  • Tier Two: Imposes a minimum 20-year registration period and includes mid-level offenses like incest, lewd acts with a minor under 14, sodomy with a minor under 14, and contacting a minor to commit a felony.
  • Tier Three: This is the most stringent tier and requires lifetime registration. Individuals in this category are typically convicted of the most severe sex crimes, such as rape by force, oral copulation by force, sex trafficking of children, lewd acts with a minor under 14 by force, felony child pornography, and pimping with a minor. Those in Tier Three have no current option to petition for removal.

Can I Be Removed From the Registry?

While the law offers a path to removal, eligibility does not guarantee success. The District Attorney in your jurisdiction may oppose your petition if they believe you still pose a threat to public safety, even if you meet the eligibility criteria. In such cases, a formal hearing will be required where a judge will decide whether to grant removal from the registry.
